External review of CAC decisions

An independent legal case review, commissioned by REA, of five recent Complaints Assessment Committee (CAC) decisions found they were generally well-reasoned, consistent and readers should be able to understand their conclusions.
REA selected five complaints about misrepresentation for review by law firm Luke, Cunningham and Clere.
Misrepresentation is a common complaint under the Code of Conduct, often involving misleading behaviour by licensees, or misleading information or advertising. Cases brought before the CACs can involve contestable evidence, and they range in seriousness, type of conduct, and harm.
REA commissioned the legal case review to as part of our process for ensuring a quality service. The review tested the reasoning, consistency, and accuracy of CAC decisions.
